John M. Kirsner

John Kirsner advises hospital systems, hospitals, large multispeciality and single-specialty group practices, clinically integrated organizations, accountable care organizations, ancillary networks, and other organizations engaged in the health care industry throughout the United States. He also has experience representing nonprofit health care associations. His substantive work focuses on issues surrounding formation and operation of health care organizations, transactional work (including purchase, sale, and M&A), payor/provider contracting, joint ventures, and other complex contracting arrangements. He has represented providers in health insurance company distress situations, including preference actions. He also has represented providers in distress, assisting on the preparation of forbearance agreements and working on debt covenant considerations.

John has assisted in the formation and operations of more than a dozen clinically integrated networks. He has assisted clients in MSSP ACO activity as well as commercial ACO activity. He has assisted in the negotiation of shared savings arrangements and in the internal network distribution strategy among network providers. [1]
