Justin Weare

Justin Weare is a commercial litigator with experience in a wide range of complex U.K. and multijurisdictional disputes resolved by litigation, arbitration, and alternative dispute resolution. His practice includes advising on matters relating to contractual and joint venture disputes, product liability, fraud, breach of duty claims, and shareholder disputes across a range of industries including manufacturing, energy, retail, and telecommunications.

Justin's representations include: defending a global real estate developer against EUR 17m ICC arbitration claim by its joint venture partner; acting for Caribbean telecommunications operator, Digicel, in a major English High Court claim, including a leading judgment on e-disclosure ([2008] EWHC 2522, [2009] 2 All E.R. 1049) against Cable & Wireless related to alleged anticompetitive practices in seven Caribbean jurisdictions; defending an arbitral claim - including interim injunctive relief - involving a £50m property in London; representing a claimant in an English Commercial Court trial relating to an onshore oil pipeline project resulting in judgment for $12.5m; defending a worldwide leader in production of spirits from a multimillion euro claim in arbitration; defending a major pharmaceutical manufacturer against a defective product claim related to a drug with annual sales revenue of approximately $1bn; defending an unfair prejudice petition; advising the liquidators of a listed energy company related to claims in the estate totaling over £100m; advising Potash Corporation of Saskatchewan as to the English law elements of its successful defense of a $40bn hostile tender offer from BHP Billiton; and a shareholder derivative action in the Cayman Islands (at first instance and on appeal).
