Kerry C. Fowler

Kerry Fowler's practice focuses primarily on complex civil litigation, particularly matters involving product liability, toxic tort, fraud and unfair business practices, consumer class actions, contract disputes, and claims arising under the Fair Credit Reporting Act (FCRA). She has represented clients in state and federal courts throughout the country, and in all phases of litigation, including discovery, motion practice, trial, and appeals. Most notably, Kerry has substantial experience defending clients against nationwide coordinated litigation, both in federal multidistrict litigation proceedings and in various coordinated state court actions.

Kerry's trial experience includes defending Yamaha Motor Co. in a three-month trial against claims of product defect, failure to warn, and negligence in connection with Yamaha's off-road, side-by-side utility vehicle known as the Rhino. The trial resulted in a complete defense verdict for Yamaha. She also was a member of the trial team defending Dole Food Company in a five-month trial involving 12 Nicaraguan plaintiffs who claimed they were rendered sterile due to exposure to a pesticide while working on banana farms in Nicaragua in the 1970s.
