Kristen McDonald focuses her practice on health care litigation, including federal and state False Claims Acts, OIG/DOJ investigations, commercial disputes between health care providers, defense of government audits, and appeals before federal and state administrative bodies. She represents providers and suppliers in civil fraud investigations involving billing, coding, medical necessity, and kickbacks, and she negotiates terms of Corporate Integrity Agreements. In addition, Kristen defends against government audits including successful appeals of extrapolated overpayments, defends providers in government enforcement actions involving civil money penalties and termination.Kristen also assists health care providers in general regulatory matters, including fraud and abuse analysis, corporate compliance programs, EMTALA, CLIA, and HIPAA/HITECH, including responses to OCR investigations of potential breaches. As part of her regulatory practice, she assists providers in implementing, revising, and evaluating the effectiveness of compliance programs. In addition, she routinely conducts health care due diligence reviews as part of mergers/acquisitions, focusing on fraud and abuse and other compliance concerns.
