Stuart Kurlander is a healthcare and life sciences partner in Latham & Watkins’ Washington, D.C. office. He is Co-chair of the Israel Practice and the former global Co-chair of the Healthcare & Life Sciences Practice. Mr. Kurlander established Latham's Washington, D.C. Healthcare & Life Sciences Practice and led it for more than 10 years.
Mr. Kurlander provides healthcare regulatory, reimbursement, fraud and abuse, corporate and litigation counsel to healthcare companies including academic medical centers, community hospitals, medical device and diagnostic manufacturers, pharmaceutical and biotech firms, and many other sectors of the healthcare industry. He represents healthcare interests at all levels of government. Mr. Kurlander serves as outside legal counsel to several private equity funds, investment banks and venture capital funds where he routinely advises on potential transactions of all types. Additionally, Mr. Kurlander advises trade associations, including AdvaMed, the largest association representing the interests of medical technology and diagnostic manufacturers worldwide. He has represented a number of healthcare companies in potential transactions including joint ventures with entities outside the United States including the Middle East, Europe and Asia.
Mr. Kurlander also represents companies on Medicare and Medicaid coverage and reimbursement matters as well as compliance matters. His client list includes a diverse array of healthcare entities, including hospitals, nursing homes, medical device manufacturers, biotech firms, pharmaceutical firms, medical suppliers, dialysis centers, rehabilitation companies, home health agencies, third-party billing companies, assisted living centers, imaging companies, radiation oncology companies, healthcare IT companies, healthcare REITs, medical office buildings and other healthcare entities.
Additionally, Mr. Kurlander advises on healthcare issues related to corporate transactions, including mergers and acquisitions, SEC matters, joint ventures, and licensing and distribution agreement issues. Lastly, Mr. Kurlander provides healthcare counsel in complex litigation matters, including qui tam suits, and regularly negotiates with the US Department of Justice, the US Department of Health and Human Services Office of Inspector General and the Center for Medicare and Medicaid Services.
Mr. Kurlander has been recognized for several years as a leading healthcare and life sciences lawyer by Chambers USA, which called him a “brilliant industry analyst and powerful advocate.” He is recognized by The Legal 500 US and Chambers USA for his healthcare practice. Mr. Kurlander was named a regulatory “Life Sciences Star” by LMG Euromoney 2015. He has also been recognized separately as one of the Top 10 outstanding hospital and nursing home lawyers by Nightingale's Healthcare News.
Prior to entering private practice, Mr. Kurlander served as an attorney in the General Counsel’s office of the US Department of Health and Human Services, Center for Medicare and Medicaid Services. In this position, Mr. Kurlander drafted Medicare and Medicaid regulations and litigated complex Medicare and Medicaid cases in federal court. In addition, he was involved in matters before the Office of the Inspector General, the Food and Drug Administration and the Public Health Service.
He regularly authors legal and regulatory articles and columns in several major healthcare publications, and speaks nationally. He serves on boards of various publications, and he is active in national and international healthcare, legal, civic and community organizations.
